1. Scope of the Agreement

1.1. This contract specifies the terms of service, legal obligations, and operational boundaries of Temren Travel, located in Cappadocia, Turkey. Unless otherwise agreed upon in a separate written contract, these provisions remain valid for all bookings made via website, e-mail, or phone.

1.2. The services provided include, but are not limited to, Private Hot Air Balloon Flights, VIP Airport Transfers, Private Guided Tours, and Custom Travel Itineraries. All products are collectively referred to as "Services".

2. Booking, Acceptance, and Age Requirements

2.1. In order to utilize our services, the Client must explicitly approve the service contract. Using the services or confirming a booking via digital channels constitutes an automatic acceptance of these terms.

2.2. Clients under the age of 18 must be accompanied by a legal guardian or provide written parental consent. If we detect that a service is being used in violation of international or local laws regarding age or eligibility, the service will be terminated immediately without any liability to the Agency.

3. Operational Modifications and Right of Suspension

3.1. Temren Travel reserves the right to stop, pause, or modify any feature of the Services permanently or temporarily without prior notice as part of our continuous quality and safety renewal process.

3.2. We reserve the right to block or suspend a Client’s access to their account or future services without providing a reason, specifically in cases of suspected fraud, misconduct, or security threats. This is accepted by the Client upon booking.

4. Pricing and Payment Policy

4.1. All service fee rates are determined by Temren Travel based on seasonal conditions and the premium nature of the service. We reserve the right to update prices at our discretion.

4.2. Unless stated otherwise, prices are exclusive of Value Added Tax (VAT) and other government levies which will be added at the time of transaction according to Turkish Law.

4.3. Payment information provided by the Client during the booking process must be accurate and up-to-date. The Agency is not responsible for errors or delays caused by banking institutions or incorrect data entry.

5. Intellectual Property and Content Usage

5.1. All content including but not limited to written texts, high-resolution photography, logos, video content, and software used on the Temren Travel platform is the sole property of the Agency or its licensors.

5.2. Clients are strictly prohibited from reproducing, copying, selling, or trading any content produced by Temren Travel without explicit written permission. Unauthorized use of our brand features (trade names, trademarks, logos) is a violation of international intellectual property law.

6. Limitation of Liability and Safety

6.1. Temren Travel acts as a premium facilitator between the Client and various third-party service providers (hotels, flight operators, etc.). While we work only with the highest-rated partners, the Agency is not liable for direct or indirect damages, loss of earnings, or data loss arising from third-party actions.

6.2. Weather-Dependent Activities: Activities such as Hot Air Ballooning are strictly dependent on weather conditions and Civil Aviation authority approvals. Temren Travel is not responsible for cancellations due to weather but will facilitate refunds or rescheduling as per the Cancellation Policy.

6.3. The Agency is not responsible for damages arising from software viruses, technical errors in the booking system, or the Client’s failure to keep their account password secure.

7. Force Majeure (Unforeseeable Events)

7.1. Neither party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, or other natural disaster), war, invasion, act of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, or blockage.

8. Termination of Relationship

8.1. The Client may terminate the service contract by sending a written request to our official address or e-mail. Termination is only valid upon receipt of a confirmation from our side.

8.2. The Agency may terminate this agreement if the Client violates any provision of this contract or if the provision of services becomes commercially unviable for the Agency.

9. Legal Disputes and Jurisdiction

9.1. This contract is governed by the laws of the Republic of Turkey. For any disputes arising from this agreement, the courts and enforcement offices of Nevşehir (Cappadocia) are exclusively authorized.

• Financial Data: While we do not store full credit card numbers, we collect billing addresses and transaction details through our secure payment gateway.

2. Use of Collected Information

Your data is used specifically for:

• Processing your reservations and providing the requested travel services.
• Communicating important updates regarding your tours (e.g., flight time changes).
• Direct marketing and promotional offers (only if explicit consent is given).
• Improving our website performance and analyzing user demographics for a better UX.

3. Advanced Payment Security

Temren Travel prioritizes the safety of credit card holders above all else. Our security infrastructure includes:

• SSL Certification: Our website uses high-grade 128-bit/256-bit SSL (Secure Sockets Layer) encryption. This ensures that all data transmitted between your browser and our servers is unreadable by third parties.
• Non-Storage Policy: We do not record or store your credit card's security codes (CVV) or sensitive card data. Transactions are handled through direct API connections with reputable banks.
• Fraud Prevention: Our system performs real-time address and bank verification to protect you against unauthorized credit card usage.

4. Cookies and Tracking Technologies

We use technical communication files, known as "Cookies," to gather statistical data such as the number of visitors and duration of visits. This data is used solely to generate dynamic content and advertisements tailored to your interests. You can disable cookies in your browser settings, though this may limit site functionality.

5. Data Sharing with Third Parties

We do not sell or lease your personal information. Data sharing occurs only with your consent and only with service providers (e.g., airlines, boutique hotels) necessary to complete your booking. In rare cases, we may share information with government authorities if required by Turkish Republic Law No. 6698 (KVKK).

6. Email and Communication Security

Please do not include sensitive credit card information in standard e-mail correspondence. For your safety, Temren Travel will never ask for your passwords or full credit card details via e-mail.
