Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is drawn up in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. By completing an online reservation and making a payment through the Temren Travel website, the Buyer is deemed to have accepted all the terms of this legally binding contract.

Article 1: The Parties

1.2. The Buyer (Client)
The person making the reservation through the www.temrentravel.com website. The contact and billing information provided by the Buyer during the online booking process will be considered accurate and taken as the basis for this contract.

Article 2: Subject of the Agreement

The subject of this Agreement is the determination of the mutual rights and obligations of the Parties regarding the electronic sale, performance, and delivery of travel services (hot air balloon flights, private tours, VIP transfers, accommodation) purchased by the Buyer via the Seller’s website, in accordance with current Turkish commercial and consumer laws.

Article 3: Service Details and Pricing

3.1. The basic characteristics of the service (tour route, date, duration, inclusions, and exclusions) are explicitly stated on the relevant tour page of the website and summarized in the final booking confirmation email.

3.2. The total price of the selected services, including all applicable taxes (VAT), is indicated on the checkout page before the final payment confirmation. Any additional services requested during the tour that are not specified in the original booking are subject to extra charges.

Article 4: Payment and Delivery

4.1. The Buyer can make the payment via approved credit cards using the secure 128-bit/256-bit SSL encrypted payment gateway on the website.

4.2. Upon successful payment, an electronic "Travel Voucher / Booking Confirmation" will be automatically delivered to the email address provided by the Buyer. This document serves as the official ticket and proof of purchase.

Article 5: Right of Withdrawal (Crucial Exception)

As per the Regulation on Distance Contracts (Distance Contracts Regulation published in the Official Gazette dated 27.11.2014 and numbered 29188), consumers generally have a 14-day right of withdrawal. However, there are legal exceptions.

Since the tours, flights, and transfers provided by Temren Travel are scheduled for specific dates and times, they fall under this exception. Therefore, standard withdrawal rights do not apply. Instead, the Buyer's right to cancel and receive a refund is governed strictly by the Cancellation and Refund Policy published on the website.

Article 6: Force Majeure

If the Seller cannot perform the contracted service due to extraordinary circumstances beyond its control (Force Majeure)—such as extreme weather conditions preventing balloon flights, natural disasters, government restrictions, or civil unrest—the Seller is obliged to notify the Buyer. In such cases, the Buyer has the right to request the cancellation of the booking for a full refund or postpone the service to a later date, subject to availability.

Article 7: Dispute Resolution

In the implementation of this Agreement, the Consumer Arbitration Committees and the Consumer Courts in the place where the Buyer purchased the service or where their residence is located are authorized up to the value declared by the Ministry of Customs and Trade of the Republic of Turkey. For international clients or disputes exceeding this value, the Courts and Enforcement Offices of Nevşehir (Cappadocia) shall have exclusive jurisdiction.
